Child Custody, Visitation, and Placement

When a couple with children divorce, in Florida, custody of the children is no longer automatically granted to the mother. Florida Courts grant custody based on what serves the "best interests of the child".  The parent who has physical custody of the child(ren) has the right and duty to care for a child(ren) on a daily basis and to make major decisions about the child. Sometimes, the physical custody of a child will be granted to one parent but the legal custody, or the ability to make decisions for the child, will be shared by both. This is called joint custody. In other situations both parents may share both physical and legal custody of the children. This is called rotating custody.  In cases where one parent does not have physical custody of his or her child(ren) on a regular basis, the court will  make a concerted effort to ensure that the child(ren) maintain a healthy relationship with the non-residential parent by providing scheduled visitation
