Case of a Driving Under the Influence in South Florida. Defendant was stopped according to the police report for driving at a slow rate of speed in a 70 mph zone. Police reported that the vehicle nearly drove off the roadway and almost struck two other vehicles. Once pulled over the officer smelled the odor of alcohol. Since this case, another lawyer copied and filed my motion but failed to argue it properly. He lost and created bad case law.  It is currently being challenged in 4th DCA. The appeal is pending and we are in November of 2025.  Stay tuned.
