A record that has been sealed can be seen by approximately 30 % of the population; law enforcement, governmental agencies, Federal institutions, etc. An expunged record is completely destroyed, although if not done properly the record may still be visible. Once the record is destroyed, no one will ever be able to access it.

The entire sealing and/or expungement process takes anywhere from eight (8) to twelve (12) months. The Law Offices of Roger P. Foley generates all of the required documentation within 7 days of being retained, (assuming you provide a certified copy of the disposition), and within 30 days if we acquire the certified documentation. Note: Attorney Roger P. Foley handles every expungement personally, not staff, because if it is done incorrectly the process can take even longer. If the application, Motion or Order are wrong, sealing or expunging of the criminal record will be substantially delayed. Mr. Foley has represented several clients that started out using a cheaper service and had problems. It is cheaper to do it correctly the first time then fixing another's mistake. The goal is sealing or expunging your record and it's disappointing when its not correctly completed. Mr. Foley reviews every document with his client to ensure that mistakes are not made. The longer the criminal record is in the public view the more difficulties you will have acquiring employment, housing, etc.
The documentation is first forwarded to the state attorney’s office and usually takes three (3) weeks to three (3) months to be returned to our office. Once received, the Petition to Seal Or Expunge is forwarded to FDLE and they take 3-4 months to return the certificate of eligibility to our office. Then an agreed order is sent to court or a hearing before the judge is scheduled. Each judge has a specific protocol for sealing and expunging records.
According to Florida law, there are specific charges that cannot be sealed or expunged, regardless of whether adjudication was withheld.
